By accessing or using EVVidence, you agree to be bound by these Terms of Service. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization.
EVVidence provides electronic visit verification software for home care agencies and related service delivery organizations. The service includes visit tracking, GPS verification, compliance reporting, and workforce management tools.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
Subscription fees are billed monthly via Stripe. Platform fees and per-worker charges are as quoted at signup. Late payments may result in service suspension after a 15-day grace period.
You agree not to: misuse the service, attempt unauthorized access, interfere with other users, submit false verification data, or use the service for any unlawful purpose.
You retain ownership of all data you submit to EVVidence. We are granted a limited license to process your data solely for providing the service.
EVVidence's liability is limited to the amount paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
Either party may terminate the agreement with 30 days written notice. Upon termination, you may export your data within 30 days. After 60 days, PHI is de-identified per our data retention policy. You are responsible for exporting and retaining records needed to meet state and federal Medicaid retention requirements before account closure.
Disputes shall be resolved through binding arbitration in accordance with AAA rules. The venue shall be the state where EVVidence maintains its principal office.
